Protecting Vulnerable Plaintiffs
When a plaintiff has a disability or injury, is a minor, or is otherwise vulnerable,
assessing their specific needs is essential. This includes determining whether they have
a disability, are receiving or applying for means-tested government benefits, or are
minors or over the age of 65.
In this presentation, we will discuss Pooled First-Party Special Needs Trusts and
Settlement Preservation Trusts and compare pooled trusts to standalone trusts. We will
also provide an overview of traditional Medicaid versus Medicaid expansion and
Supplemental Security Income (SSI) and Social Security Disability Insurance (SSDI).
Additionally, we will outline the necessary steps to protect these essential benefits.
Furthermore, we will review Medicare Set-Asides (MSAs) and structured settlements,
including how they can be coordinated with a trust. Finally, we will examine the
process for assisting with court orders or settlement agreements and the contractual
documents related to the MSA or structured settlement.
